TRADEMARK (SPANISH LAW).- Trademark is every sign which may be drawn and which distinguishes products or services in the market from one company to other ones. These signs may be, particularity: a) Words or its combinations, enclosing words which it identifies persons. b) Images, forms, symbols and drawings. c) Characters of the alphabet, numbers and its combinations. d) Three-dimensions forms as: bundles, packing boxes, product shapes, etc. e) Sonorous. f) Every sign combination which it has been named before.

TRADE NAME (SPANISH LAW).- Trade Name is every sign which may be drawn and which it identifies a company in a business activity and which it distinguishes it from other companies with identical or similar business activities. These signs may be, particularity: a) Patronymic names and company names. b) Fantasy denominations. c) Business activities denominations. d) Anagrams and logos. e) Images, forms and drawings. f) Every sign combination which it has been named before.

Spain Trademark Law points out that if the Address of an Owner Spanish or International Trademark which is in force in Spain, it has its address outside Spain, then this company or woman/man must have one Spain address for all its Official Notifications.

Before applying for any sign, it is advised to carry out a similar denomination searching in order to analyse the sign grant probability and to save some money if this grant probability is small.

PATENT (SPANISH LAW).- Any Inventions, which are new involve an inventive step, shall be patentable, provided they are susceptible of industrial application.
The following shall be exceptions:

1. Discoveries, as well as scientific theories and mathematical methods.
2. Literally or artistically creations or any other aesthetic creations, as well as scientific creations.
3. Schemes, principles, and methods for performing mental acts in playing games or doing business, and programs for computers as such.
4. Presentations of information.

The duration of a patent of invention shall be of 20 years computed from the date of the respective application (except in medicaments and phitosanitary products).

UTILITY MODELS (SPANISH LAW).- Any inventions which are new, involve an inventive step, are capable of industrial application and which consist in giving to an object an appearance, structure, or arrangement which may increase the utility thereof or improve its use, may be protected as utility models.

The duration of an utility model shall be of 10 years computed from the date of the respective application.

COMMUNITY TRADE MARKS (EUROPEAN UNION REGULA-TIONS).- Community trademarks may consist of a sign or group of signs capable of graphic representation, namely words, including personal names, designs, letters, numerals, the shape of the product, or its respective packaging, which are capable of distinguishing the goods or services of one company from those of other companies.

Community trademark shall have an Unitarian character and shall produce the same effects in all European Union Countries.

INTERNATIONAL TRADEMARK (MADRID AGREEMENT AND/OR PROTOCOL).- It is an international process of trademark of trademark registration in order to obtain protection in some countries by means of an unique trademark application.
It is possible to obtain protection in alls or only in same of the countries which have signed The Madrid Agreement and/or The Protocol.

INDUSTRIAL MODEL (SPANISH LAW).- Any object which may be used as type in order to make a product and which may be defined by its form, dimensions, structure or ornament, may be protected as industrial model.

INDUSTRIAL DESIGN (SPANISH LAW).- Any combination of lines or colours or of lines and colours, applied to a product with a commercial purpose, by means of any manual, mechanical or chemical process, may be protected as industrial design.

The duration of an industrial model or design shall be of 10 years and may be renewed by other 10 years.
